DI MANA SUMPAH TUN DR MAHATHIR DALAM ISU TUN SALLEH ABAS?

Dunia tahu apa asas-asas sebenar yang digunakan untuk memecat Tun Salleh Abas.

Tiada di dalam rekod tribunal yang membicarakan Tun Salleh mengenai kewujudan sepucuk surat yang kononnya ditulis oleh beliau kepada DYMM Yang di-Pertuan Agong waktu itu, Almarhum Sultan Iskandar Ibni Almarhum Sultan Ismail, mengadu mengenai bunyi bising yang terhasil ekoran kerja pembaikian istana Baginda berdekatan rumah Tun Salleh, yang kononnya menjadi punca utama kepada pemecatan Tun Salleh sebagai Ketua Hakim Negara.

Bagaimanapun, inilah yang diwarwarkan oleh Tun Dr Mahathir Mohamad, insan yang bertanggungjawab sepenuhnya ke atas pemecatan Tun Salleh pada tahun 1988 dahulu.

Sangat pelik kenapa hanya setelah Tun Abdullah Ahmad Badawi mengumumkan, di dalam Makan Malam Bar Council Malaysia di JW Marriott Hotel, Kuala Lumpur, pada 17 April 2008, bahawa kerajaan akan membuat bayaran ex gratia kepada Tun Salleh barulah Tun Dr Mahathir mendedahkan kewujudan surat yang kononnya ditulis oleh Tun Salleh ini.

Di dalam posting bertajuk “The Tun Salleh Saga” di blog beliau, Che Det, pada 6 Jun 2008, Tun Dr Mahathir menulis:
7. In his first letter Tun Salleh had written to DYMM YDP Agong complaining about the noise made during some repair work at the Agong’s palace near Salleh’s house.
8. This alone can be considered as very improper. A man as senior as he was could have asked to see the Agong and verbally informed him about the noise.
9. But to compound the act of les majesté he sent copies of his letter to the other rulers. This implied that he did not have faith in the Agong and wanted the other Rulers to apply pressure on him.

Ini Tun Dr Mahathir teruskan lagi dengan mendakwa di dalam memoir beliau bertajuk “A Doctor in the House: The Memoirs of Tun Dr Mahathir Mohamad” yang diterbitkan pada tahun 2011 dengan menulis: “By tradition, the Prime Minister sees the Agong every Wednesday morning before chairing the Cabinet meeting. This was mostly a matter of courtesy, but occasionally the Agong would give his opinion of the Cabinet papers or bring up matters which he felt the Prime Minister needed to know. At one such meeting in early 1988, the Agong showed me a letter that Tun Salleh had written to him, complaining about the noise that was being made in the course of repairing the Agong’s private residence near Tun Salleh’s own house. The Agong felt insulted – it was not in keeping with Malay custom to write a letter of complaint to a Ruler, much less the King. A very senior officer of the Government should seek an audience and politely mention the matter. But Tun Salleh had not only written the letter, he had also forwarded copies to all the other Rulers, a move the Agong regarded as an attempt to pressure and embarrass him. He then insisted that I remove Tun Salleh as Lord President, a decision he noted in the margin of Tun Salleh’s letter.”

Semalam, 26 Julai 2017, dalam sidang media Majlis Pimpinan Tertinggi Parti Pribumi Bersatu Malaysia (PPBM) di Petaling Jaya, Selangor, Tun Dr Mahathir sekali lagi mengemukakan dakwaan ini dengan berkata: “I have already explained this. It was not me. It was a complaint coming from the Agong, but the Attorney General at that time did not want to mention the Agong. Instead he used my name and gave reasons to the tribunal which are not even known to me. So I have explained this, but of course people still insist that it was because of me that the Lord President was removed, judges were removed. It was not me. But unfortunately because the Attorney General at that time did not want to mention the Agong, so he said that it was me who complained. But I did not complain.”

Mengenali Tun Salleh, saya segera menghubungi beliau sebaik sahaja saya membaca posting Tun Dr Mahathir pada 6 Jun 2008 untuk bertanya beliau sendiri mengenai dakwaan kewujudan surat ini. Bagaimanapun, Tun Salleh bertegas menyatakan bahawa beliau tidak pernah menulis surat yang Tun Dr Mahathir dakwa beliau tulis kepada DYMM Yang di-Pertuan Agong ini.

Petang semalam, 26 Julai 2017, sebaik sahaja saya mendengar kenyataan terbaru Tun Dr Mahathir ini, saya sekali lagi menghubungi Tun Salleh untuk bertanya beliau sendiri mengenai dakwaan kewujudan surat ini. Bagaimanapun, Tun Salleh sekali lagi bertegas menyatakan bahawa beliau tidak pernah menulis surat yang Tun Dr Mahathir dakwa beliau tulis kepada DYMM Yang di-Pertuan Agong ini.

Beberapa pihak yang lain telah pernah menyatakan pandangan mereka mengenai dakwaan Tun Dr Mahathir ini.

Di antara mereka ialah Profesor Emeritus Undang-Undang di Monash University, Australia, H P Lee, yang menulis di dalam buku beliau bertajuk “Constitutional Conflicts in Contemporary Malaysia” (edisi kedua, 2017): “Not much credibility appeared to be given to this self-serving explanation by Dr Mahathir Mohamad”.

Seorang penulis, Ahmad Lufti Othman, di dalam rencana beliau, bertajuk “Menyanggah Memoir Mahathir”, pada 8 Mac 2011 pula lebih lantang lagi. Tulis beliau: “Jelas ia satu pembohongan. Kalaupun Agong murka dengan Tun Salleh atas alasan peribadi, Perdana Menteri bertanggungjawab menasihati baginda bahawa kes sekecil itu langsung tidak membabitkan salahlaku kehakiman sehingga memerlukan penggantungan dan penubuhan tribunal.”

Tun Dr Mahathir sendiri pernah menyebut di dalam memoir beliau bahawa beliau sedia bersumpah bahawa surat itu wujud dan bahawa ekoran daripada surat itulah maka Almarhum Sultan Iskandar Ibni Almarhum Sultan Ismail menitahkan beliau untuk memecat Tun Salleh dengan menulis: “I am prepared to swear on the Qur’an that it was the letter and the instruction from the Agong which caused action to be taken to remove Tun Salleh Abas”.

Disebabkan Almarhum Sultan Iskandar Ibni Almarhum Sultan Ismail sudah tiada, disebabkan Peguam Negara waktu itu, Tan Sri Abu Talib Othman, enggan bersuara, dan disebabkan Tun Dr Mahathir sendiri pernah menyebut bahawa beliau sedia bersumpah bahawa surat itu wujud dan bahawa ekoran daripada surat itulah maka Almarhum Sultan Iskandar Ibni Almarhum Sultan Ismail menitahkan beliau untuk memecat Tun Salleh, maka Tun Dr Mahathir sepatutnya segera bersumpah bagi membuktikan kebenaran dakwaan beliau ini.

Tidak guna sekadar menyebut kamu sedia bersumpah, terus bersumpah sahajalah jika betul kamu orang yang benar, wahai Tun Dr Mahathir!
